An attorney who provided then-President Donald Trump with legal advice following the controversial 2020 election aftermath has drawn a line in the sand when it comes to special counsel Jack Smith’s ongoing probes into the Jan. 6, 2021, Capitol riot.

Harvey Silverglate, a lawyer for Trump adviser John Eastman, said he wouldn’t cooperate with Smith or other federal prosecutors and that his client has no plans to cut any deals.

Silverglate spoke to Fox News host Laura Ingraham where he said that his client gave “good faith legal advice” when he said that former Vice President Mike Pence could refuse to certify President Biden’s election.

“It was certainly cutting-edge. It was creative,” Silverglate said of Eastman’s theory. “But, you know, that’s what good lawyers are supposed to do. And Eastman’s advice was perfectly within the realm of good faith legal advice. I don’t have any doubt about it. I’m sure we can get experts to testify to that if necessary. If Eastman is charged, he’s going to trial. If he is convicted, he’s going to appeal. We will never, ever make a deal.”

“Well, I don’t understand. Their argument is, he was facilitating a crime with the advice?” Ingraham, who is also an attorney, responded. “And obviously their interpretation of these statutes and the application of the statutes themselves are novel legal theories without real clear intent established. So, they’re guilty of the standard that they are applying to Trump and Eastman, I guess, and the others…it’s crazy!”

“This whole thing has become so politicized that it’s not even funny. And it is a blot on the Department of Justice, in my view,” Silverglate said.

“So, we are giving away our defenses. But we are that confident in our case that we’re willing to tell them what our arguments are in order to keep them from indicting him,” he said.

He also said that the California Bar is considering removing Eastman’s law license because of his role in advising Trump following his election loss.

“The bar association, instead of waiting for the outcome of the court process, is looking to disbar and take away his ability to fund his own defense in the criminal case, do you see what see I’m saying?” the attorney said.


“So, that’s a shameful political development in California,” Silverglate added.

Meanwhile, a spokeswoman for Trump ripped into the Biden Justice Department and special counsel Jack Smith after the former president appeared in a federal court on Thursday to be arraigned on new felony charges related to riot.

Alina Habba, who is also an attorney, blasted the charges as overt “election interference at its finest” in front of the courthouse after Trump appeared.

Earlier in the day, Trump arrived in the nation’s capital to appear for his third indictment and his second by Smith, who charged him with four felony counts, including conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of an attempt to obstruct an official proceeding, and conspiracy against rights.

During her press conference, Habba noted that all of Trump’s indictments appear to come as first son Hunter Biden and President Joe Biden appear in the news amid allegations of corruption. She pointed to former business partner Devon Archer’s closed-door testimony before a House committee on Monday, which was followed up by Trump’s indictment on Tuesday.

“This is not a coincidence. This is election interference at its finest against the leading candidate right now for president for either party,” Habba said (see video below). “President Trump is under siege in a way that we have never seen before. President Trump and his legal team and everyone on his team will continue to fight, not for him, but for the American people.”

She added that the ongoing “witch hunt” against Trump goes beyond a simple political battle.
